If you do not agree, you must discontinue use of this Website immediately.

These Terms apply to all users of the Website, including visitors, registered users, and anyone who accesses or uses our services.

Holidaybreakz.ca ("we," "us," "our," or the "Company") is an online travel agency operating in Canada that facilitates the booking of travel-related products and services. We act as an intermediary between travellers and third-party service providers including airlines, hotels, car rental companies, cruise lines, and tour operators. We are not the direct supplier of any travel product or service offered on this Website.

2. ELIGIBILITY

To use this Website and make bookings, you must:

  • Be at least 18 years of age;
  • Be legally capable of entering into a binding contract;
  • Provide accurate, complete, and truthful information; and
  • Comply with all applicable laws and regulations.

3. USER RESPONSIBILITIES

You agree to:

  • Not make speculative, fraudulent, or unauthorized bookings;
  • Not use automated tools, bots, or scrapers on the Website;
  • Not attempt to circumvent or interfere with Website security or operations; and
  • Maintain the confidentiality of your account credentials, if applicable.

Violation of these obligations may result in immediate account suspension, booking cancellation, and legal action.

4. BOOKING AND PAYMENT

4.1 Booking Confirmation

A booking is only confirmed once you receive a written confirmation email from holidaybreakz.ca containing a booking reference number. Submission of a booking request does not guarantee availability, pricing, or confirmation. We reserve the right to decline any booking at our discretion.

4.2 Pricing
  • All prices are displayed in Canadian Dollars (CAD)and include applicable taxes unless otherwise stated.
  • Prices are not guaranteed until payment is received in full and a confirmation is issued.
  • Prices may change at any time due to airline or supplier fare changes, availability, demand, currency fluctuations, or technical factors.
  • Holidaybreakz.ca may charge a service fee in addition to the base fare, which will be disclosed before checkout. Service fees are non-refundable.
4.3 Payment
  • We accept major credit and debit cards including Visa, Mastercard, and American Express.
  • All transactions are processed through encrypted, secure payment gateways.
  • Holidaybreakz.ca does not store full payment card details on its servers.
  • By completing a booking, you authorize us to charge the full amount to your provided payment method.
  • If payment is declined, your booking will not be confirmed.
4.4 Pricing Errors

We make every effort to ensure pricing accuracy. In the event of a pricing error, we reserve the right to:

  • Cancel the booking and issue a full refund of all amounts paid to holidaybreakz.ca; or
  • Offer you the option to proceed at the corrected price.

This applies even after a booking has been confirmed. We will notify you promptly. holidaybreakz.ca is not liable for any costs or losses arising from a pricing error or consequent cancellation.

5. CANCELLATIONS, CHANGES, AND REFUNDS

5.1 General

Cancellation and refund eligibility are governed by the fare rules and policies of the respective service provider at the time of booking. holidaybreakz.ca's service fees are non-refundable under all circumstances. You must carefully review all fare rules, restrictions, and cancellation policies before completing a booking.

5.2 Cancellation by You
  • Refundable bookings cancelled within the permitted timeframe may be eligible for a full or partial refund, less applicable penalties and holidaybreakz.ca's service fee.
  • Non-refundable bookings are not eligible for any refundupon cancellation.
  • To cancel a booking, contact us at support@holidaybreakz.ca or +1-877-552-0779 with your booking reference number.
5.3 Changes to Bookings

Any modification to a confirmed booking (including date changes, name corrections, routing changes, or upgrades) is subject to the service provider's amendment policy and may result in:

  • Change fees charged by the airline, hotel, or supplier;
  • A fare difference payable by you; and
  • An administrative handling fee charged by holidaybreakz.ca.

Name changes are subject to airline and supplier policy and may not be permitted. holidaybreakz.ca cannot guarantee that any requested change will be available or actioned.

5.4 Cancellation by holidaybreakz.ca

We reserve the right to cancel any booking, including due to pricing errors, fraud, non-payment, or supplier cancellation. In such cases, we will issue a full refund of the amounts received by us. holidaybreakz.ca is not liable for any additional costs or losses arising from such cancellations.

5.5 Refund Processing

Approved refunds will be credited to your original payment method. Refund timelines depend on the supplier and your financial institution and may take 7–30 business days. holidaybreakz.ca is not responsible for delays caused by third-party processors or financial institutions.

6. NO-SHOW POLICY

Failure to use a booked service without prior cancellation may be treated as a "no-show" by the service provider and may result in forfeiture of the full booking amount. No-show policies vary by airline, hotel, car rental company, and cruise line. holidaybreakz.ca assumes no liability for amounts forfeited due to no-shows.

7. FLIGHT BOOKINGS

  • All flights are subject to the applicable airline's Conditions of Carriage, which form the contract of carriage between you and the airline. holidaybreakz.ca is not a party to that contract.
  • It is your responsibility to check in within the airline's required timeframe and to present at the departure gate with sufficient time for boarding.
  • Baggage allowances, fees for excess or oversized luggage, and carry-on restrictions are determined solely by the airline.
  • In the event of flight delays, cancellations, or disruptions, your rights are governed by the airline and applicable air passenger protection regulations under the Air Passenger Protection Regulations (APPR).
  • Some itineraries may involve codeshare or interline flights operated by carriers other than the ticketing airline. Different policies may apply.
  • Holidaybreakz.ca accepts no liability for missed flights, denied boarding, or flight disruptions.

8. HOTEL BOOKINGS

  • Hotel cancellation and amendment policies vary by property and rate type and are communicated at the time of booking.
  • Non-refundable hotel ratescannot be cancelled or amended for any refund.
  • The property sets standard check-in and check-out times. Early check-in or late check-out is subject to availability and may attract additional charges.
  • Room descriptions and images are provided by the hotel and are for general reference only. Actual configurations may vary.
  • Some properties charge mandatory fees(resort fees, destination fees, or similar) payable directly to the hotel. These are not included in the rates displayed on our Website. You are responsible for paying all such charges.
  • Holidaybreakz.ca is not responsible for the quality, condition, or suitability of any property.

9. CAR RENTAL BOOKINGS

9.1 Driver Requirements
  • The lead driver must hold a valid driver's licencefrom their country or province of residence.
  • Minimum driver age requirements vary by rental company and destination. Drivers under 25 may be subject to a Young Driver Surcharge.
  • An International Driving Permit (IDP)may be required at certain destinations. It is your responsibility to verify requirements.
9.2 Credit Card and Deposit
  • A valid credit card in the lead driver's nameis required at vehicle collection for a security deposit or pre-authorization. Prepaid or debit cards may not be accepted.
  • Failure to present a qualifying credit card may result in the refusal of the rental without refund.
9.3 Rental Agreement

The rental company's rental agreement governs the rental. holidaybreakz.ca is not a party to that agreement. You are advised to read it carefully before signing.

9.4 Insurance
  • Basic third-party liability insurance may be included as required by local law.
  • Additional coverage (CDW, SCDW, theft protection, personal accident insurance) is available at an extra cost and is governed by the rental company's terms.
  • Common exclusions include tyres, windscreens, roof, undercarriage, and driving under the influence.
  • Holidaybreakz.ca recommends purchasing comprehensive coverage and/or travel insurance.
9.5 Fuel Policy

Fuel policies vary by supplier (full-to-full, full-to-empty). The applicable policy will be communicated at booking. Non-compliance may result in refuelling charges at above-market rates.

9.6 Permitted Use

Vehicles must be operated in accordance with all applicable traffic laws. Off-road use, driving in unauthorized countries, or use in breach of the rental agreement is strictly prohibited and may void insurance coverage.

9.7 Accidents and Incidents

In the event of an accident, theft, or breakdown, you must notify the rental company and local authorities (where required) immediately and follow all procedures in the rental agreement. Failure to report an incident may void coverage and expose you to full liability.

10. VACATION PACKAGES

  • Vacation packages may include combinations of flights, accommodation, car rentals, transfers, and activities at a bundled price.
  • Individual components of a package cannot be separated or repriced after booking.
  • Cancellations or changes to a package may affect all components simultaneously. Fees and restrictions applicable to each component apply independently.
  • Holidaybreakz.ca is not responsible for the performance of any individual component by its respective supplier.
  • For all-inclusive packages, inclusions are determined by the resort and are subject to change. holidaybreakz.ca makes no assurance as to the availability or quality of all-inclusive services.

11. CRUISE BOOKINGS

  • All cruise bookings are subject to the cruise line's Passenger Ticket Contract, which governs liability, itinerary changes, conduct, and passenger rights.
  • Cruise itineraries are subject to change at the cruise line's discretion due to weather, port availability, or operational factors.
  • Cruise cancellation penalties increase progressively as the departure date approaches. Review the applicable schedule carefully before booking.
  • Port charges, fuel supplements, and gratuities may not be included in displayed fares and may be payable directly to the cruise line.
  • Cruise lines may impose health, medical, and vaccination requirements. It is your responsibility to meet all such requirements. Denied boarding due to non-compliance will not entitle you to a refund from holidaybreakz.ca.

12. TRAVEL DOCUMENTS AND ENTRY REQUIREMENTS

It is your sole responsibility to ensure you hold all required and valid travel documents before departure, including:

  • A valid passport with sufficient validity (typically six months beyond your intended stay);
  • Applicable visas, electronic travel authorizations (eTAs), or entry permits for destination and transit countries;
  • Health certificates, vaccination records, or medical documentation as required; and
  • Any other documentation required by immigration or border authorities.

Entry into any country is at the absolute discretion of that country's immigration authorities. holidaybreakz.ca accepts no responsibility for denied boarding, visa refusal, refusal of entry, or deportation, and no refund will be issued in such circumstances. Travel document requirements are subject to change. You are advised to verify current requirements with the relevant embassy, consulate, or official government authority.

13. TRAVEL INSURANCE

Holidaybreakz.ca recommends that all users purchase comprehensive travel insurance prior to departure to protect against trip cancellation, medical emergencies, baggage loss, travel delays, and other unforeseen events.

Where travel insurance is offered through our Website, it is provided by a licensed third-party insurer. holidaybreakz.ca acts as a facilitator only and is not an insurer or underwriter. All insurance products are subject to the terms of the issuing insurer.

We are not liable for any loss that would have been covered by adequate travel insurance.

14. THIRD-PARTY SERVICE PROVIDERS

Holidaybreakz.ca acts as a booking intermediary. We do not own, operate, or control any airline, hotel, car rental company, cruise line, or other service provider accessible through our Website. We accept no responsibility for:

  • The actions, omissions, errors, or failures of any third-party provider;
  • The quality, safety, or fitness of any third-party product or service;
  • Any disruption, cancellation, or change initiated by a third party; or
  • Third-party data handling or security practices.

By completing a booking, you enter into a direct contractual relationship with the relevant supplier, governed by that supplier's own terms and conditions.

15. PAYMENT VERIFICATION AND FRAUD PREVENTION

We reserve the right to request additional identity verification before confirming any transaction. Suspected fraudulent bookings may be cancelled without prior notice and Website access may be restricted. If your booking is cancelled under this provision, we will endeavor to notify you promptly.

16. CHARGEBACKS AND DISPUTES

You agree to contact us directly at support@holidaybreakz.ca or +1-877-552-0779 to resolve any billing dispute before initiating a chargeback with your card issuer. Misuse of the chargeback process, including filing fraudulent or unjustified chargebacks, constitutes a material breach of these Terms and may result in account suspension, cancellation of bookings, and recovery of costs incurred by us, including legal fees.

17. INTELLECTUAL PROPERTY

All content on this Website, including text, images, logos, designs, and software, is the property of holidaybreakz.ca  or its licensors and is protected under applicable copyright and trademark laws. You may not copy, reproduce, distribute, or exploit any content from this Website without our prior written consent.

18. THIRD-PARTY LINKS

Our Website may contain links to third-party websites for your convenience. These links do not constitute an endorsement or affiliation. holidaybreakz.ca has no control over the content, accuracy, privacy practices, or availability of any third-party site. We are not responsible for any loss or damage arising from your use of a linked website. Accessing third-party links is entirely at your own risk and is subject to that website's own terms and conditions.

 

19. PROMO CODES AND COUPON CODES

  • Promo codes are valid for online purchases only. Certain codes may only be applied over the phone through our customer service centre.
  • Sign up for our newsletter to receive promo codes by email.
  • Discounts are applied only against holidaybreakz.ca's service fees, up to a maximum of 70% of those fees.
  • Promo codes are non-transferable, have no cash value, and cannot be sold or bartered.
  • The code must be entered in the designated field on the payment page at the time of purchase. Codes cannot be applied retroactively after a booking is completed, under any circumstances.
  • If the promo code field is not visible or the code is not accepted due to a technical issue, you have the right not to proceed with the purchase. No credit or discount will be applied after the fact.
  • Promo codes cannot be combined with any other offer or discount.
  • Offers may be revised or withdrawn at any time without notice. Once withdrawn, the code will be rejected at checkout. You may either proceed at the original price or not complete the purchase — no exceptions.
  • The final price displayed at checkout, with or without a promo code applied, is the amount that will be charged. No adjustments will be made after purchase for any reason.
  • We reserve the right to cancel or decline any booking where a coupon error has affected the transaction, even after a booking confirmation has been issued.

20. PRIVACY

Your use of this Website is governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect, use, and disclose personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.   • Travel disruptions, delays, cancellations, or missed connections;
  • Errors or omissions in third-party supplier information;
  • Denied boarding, visa refusal, or entry denial;
  • Loss of data or unauthorized access to your account; or
  • Any act or omission of a third-party service provider.

Where liability cannot be fully excluded under applicable law, our total liability to you for any claim is limited to the amount paid by you to holidaybreakz.ca  for the booking giving rise to the claim.

22. DISCLAIMER OF WARRANTIES

This Website and all services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Website will be uninterrupted, error-free, or free from viruses or harmful components. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

23. INDEMNIFICATION

You agree to indemnify and hold harmless holidaybreakz.ca and its affiliates, directors, and employees from and against all claims, damages, liabilities, costs, and legal fees arising from your use of this Website, your violation of these Terms, or your violation of any third party's rights.

24. FORCE MAJEURE

Holidaybreakz.ca is not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, epidemics, acts of war or terrorism, government actions, travel restrictions, strikes, or infrastructure failures.

25. ACCOUNT SUSPENSION AND TERMINATION

We reserve the right to suspend or terminate your account and access to the Website at any time, without prior notice, for breach of these Terms, fraudulent conduct, misuse of the chargeback process, or any activity that poses a risk to the integrity of our platform. Upon termination, all pending bookings may be cancelled without refund where termination arises from your breach.

26. AMENDMENTS

Holidaybreakz.ca may revise these Terms at any time. Changes take effect immediately upon posting. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms regularly.

27. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall first be addressed through good-faith negotiation. Unresolved disputes shall be submitted to binding arbitration in Ontario in accordance with applicable arbitration rules, unless otherwise required by law. You hereby consent to the jurisdiction of the courts of Ontario for any matters that proceed to litigation.

28. SEVERABILITY

If any provision of these Terms is found to be unenforceable, that provision will be severed and the remaining Terms will continue in full force and effect.

29. NEWSLETTERS AND MARKETING COMMUNICATIONS
